If you hold Spain's non-working residence permit, the "non-lucrative" visa, you can't base a DNV application on remote work done on it. A US, Canadian or Australian passport holder who enters without a visa meets it, as long as they're within the short-stay limit. Someone who needs a visa can enter on a Schengen visa. The consular visa is enough on its own to live and work remotely in Spain. You don't need to apply for the residence card. The visa "constituirá título suficiente para residir y trabajar a distancia en España", and that holds "sin necesidad de tramitar la tarjeta de identidad de extranjero" (art. 75.4). If an in-Spain application isn't answered in time, it counts as granted: "se entenderá estimada por silencio administrativo".

A footnote on the residence card. Spain's general immigration rules (RD 1155/2024) say something different for long visas, and the special law for this visa is taken to win. If your consulate's visa notice tells you to get a residence card anyway, follow the notice.

Most applicants file in Spain. One Spanish adviser we spoke to in October 2026 put it at about four in five, because it gives up to 3 years straight away. Advisers describe the consulate route as slower in practice, with more requests for documents and hard-to-get appointments.

One rule needs planning around. While your in-Spain application is pending, you can stay in Spain. But it gives you no right to leave and come back in. Don't plan trips while your file is pending.

Compass asks where you live now and which passport you hold. Gross means before tax. That's €2,442 a month on the 2026 figures at a consulate, and plan for €2,849 a month (€34,188 a year) if you file in Spain. The first family member adds 75% of the minimum wage, and each further member 25%.

The rule comes from the 2023 Joint Instruction and is repeated on the immigration office's checklist: "mensualmente el 200% del salario mínimo interprofesional (SMI)", twice the minimum wage every month. Royal Decree 126/2026 sets it at €1,221 a month for 2026, paid 14 times a year, so €17,094 a year. Household totals are our arithmetic, worked out on the unrounded figures and then rounded to the cent. Checked 29 October 2026.

My advice, and the figure Compass uses: if you file in Spain, plan for €2,849. If the office reads the rule the lower way, you've lost nothing. If it reads it the higher way and you planned on €2,442, you've lost months.

The figures are gross: "brutas antes de retenciones por cualquier causa", before tax and any other deductions, says the immigration office's checklist for main applicants. The money must show up the same way twice: on your payslips or invoices, and as matching payments into your bank account. A mismatch was one of the refusal triggers advisers reported in 2026.

Savings can help, within limits. The same checklist lets savings cover a shortfall in income for the whole length of the permit, shown with up-to-date bank certificates. Savings never replace work income. And over a permit of up to 3 years, a small monthly gap becomes a large sum.

Assume a partner's income doesn't count. In practice the main applicant covers the whole household figure, though we haven't seen this written as a rule either way. If you're paid in another currency, show the amounts in that currency and in euros. If the office names an exchange rate, use it.

What counts as qualifying remote work for the DNV?

The DNV counts remote work for companies outside Spain, as an employee or a freelancer, where the relationship has lasted at least 3 months and the company has been active for at least 1 year. The immigration office expects a letter from your employer allowing you to work from Spain, with your duties and your gross salary in euros. Add your contract, recent payslips and the matching bank entries. Describe the duties as remote work: duties that read as on-site work were a refusal trigger in 2026. If your employer has a branch in Spain, the DNV is closed to you.

Check how long your contract runs. Advisers report that in 2026, if a contract ends sooner than 3 years, the permit can be granted only up to that end date. An open-ended contract, or a signed extension before you file, avoids that. The same applies to freelance service contracts.

Freelancers

Spanish clients are fine as long as that work is no more than 20% of your total professional activity: "no sea superior al 20 % del total de su actividad profesional" (art. 74 bis.1). The law doesn't say how to measure it. Our own working measure is your share of invoiced income, and we aim for 15% or less to leave a buffer. You prove the work with client contracts, invoices and the matching payments. The companies you work with need the same year of activity and 3 months of history with you.

Company owners

"Can I use my own company?" Sometimes, but it's the hardest Spain digital nomad visa file to get approved. If you're the sole owner, or you have effective control, "control efectivo", meaning you run the company in practice, the immigration office's checklist asks for four extra documents. Each one tests whether your company is a real business or a shell for your own work.

Owner document

What the immigration office is checking

Where one-person companies struggle

1. If you own 100% and the company has more than a year of real, continuous activity, the immigration office treats the 3-month work relationship as met. And you don't need a letter allowing remote work, because you'd be signing it yourself. If you can't produce the company documents, the checklist's fallback is your own personal tax return for the previous year.

Is it realistic? For a real operating company, yes. That means one that files its own accounts and tax return, has staff on payroll, owns its equipment or premises, earns from clients rather than from you, and pays you a regular salary into your personal account. For a one-person company that exists to invoice your own clients, approval is a long shot in 2026. From February 2026, advisers reported refusals where the income came from a company the applicant solely owned. The Spanish adviser we spoke to steers owners away from filing on that basis.

What do owners do instead? The usual route is to apply as a freelancer. That means a contract between you, as an individual, and a client company you don't own, which has existed for at least a year, with at least 3 months of invoices paid into your personal account. Your company can keep running; it simply isn't the basis of the application. That's dated practice to reduce risk, and the law doesn't require it. If almost all your income sits in your own company and you can't build that track record, check whether the DNV is the right route before you spend money on documents.

The rules set no percentage threshold, so the claim that owning 25% or less is "safe" has nothing official behind it.

Home-country sole traders

A sole-trader registration in your home country with foreign clients is a different, simpler case. You invoice as yourself, so the owner documents don't apply in the same way. In one 2026 example, a sole trader with clients abroad filed in Spain on 24 April and was approved on 29 June.

What documents do you need for the Spain digital nomad visa?

The Spain digital nomad visa file needs your full passport, the application form, work and company evidence for your profile, a degree or proof of 3 years' experience, criminal record certificates from every country you've lived in during the last 2 years plus a signed 5-year declaration, and health cover unless you'll join Spanish Social Security. You also sign a declaration covering 5 years. So: certificates for 2 years, a declaration for 5. A consulate can ask for more.

Health cover

The law asks for "un seguro público o un seguro privado de enfermedad", public or private health insurance, and the immigration office fills in the detail. If you'll register with Spanish Social Security after approval, you don't need a separate policy. If you won't, you need cover from an insurer licensed in Spain, with no co-payments and no waiting periods. Travel insurance isn't accepted: "no se aceptan seguros de viaje". Family members not covered through Social Security need their own policy.

Social Security

Spain has a self-employed registration, "RETA", short for Régimen Especial de Trabajadores Autónomos, inside its Social Security system. Someone registered in it is an "autónomo", which means self-employed. Employees usually join the general employee scheme instead. The immigration office's FAQ lets employees bring a certificate from their home country's system instead, where an international agreement applies and the certificate "expresamente indique que da cobertura al teletrabajador en España", says clearly that it covers telework in Spain.

For freelancers, the immigration office's own documents conflict. The FAQ says freelancers must register as self-employed, while the main-applicant checklist describes the home-certificate exception for teleworkers generally. Our reading: most freelancers register as self-employed, and a home certificate works only where a treaty applies and it says so in writing.

Apostilles and sworn translations

Foreign public documents, such as criminal records, degrees and birth or marriage certificates, need an apostille. If your country isn't in the apostille system, they need legalisation by a Spanish consulate instead. Then they need a full sworn translation into Spanish. Private documents such as contracts and invoices generally don't need an apostille.

In 2026, apostilles with a QR code the office couldn't verify caused problems, so check yours scans. Documents in a language with no sworn translator in Spain can need a longer chain of translations, so start those first.

Do you need a lease or proof of address for the Spain digital nomad visa?

You don't need a lease to apply for the Spain digital nomad visa from inside Spain. A hotel or holiday rental address is fine for the application. People report that the police there take fingerprints without the town-hall registration. In Madrid and Barcelona, a short-term rental has been accepted for the registration itself. Elsewhere, expect to need a longer rental contract. Sort out a stable address before your approval arrives, so the registration doesn't hold up your card.

What if your passport needs a Schengen visa to enter Spain?

If your passport needs a visa to enter Spain, you can still use the in-Spain DNV route. Get a Schengen visa, which any Schengen country can issue, enter Spain, and file while your stay is legal. Count your days: a short stay is capped at 90 days in any 180, and by what your visa allows.

Needing a visa to enter doesn't mean the consulate is your only path. The legal test is the same for everyone: being legally in Spain on filing day.

If you hold a residence permit from another Schengen country, you don't need a visa at all. It lets you enter Spain and stay up to 90 days in any 180, and that counts as being legally present for filing. An expired visa or permit doesn't.

A dated example. A couple whose main applicant was a freelancer with foreign clients got a Schengen visa, entered Spain and filed on 30 June 2026, after about six and a half weeks of preparing documents. The main applicant was approved on 12 August and the spouse on 10 September.

Two cautions. Entering through another Schengen country brings in the proof-of-presence problem below. And your visa's end date is a hard limit, so plan backwards from it. Use our Schengen calculator to count your 90/180 days before you book. If the timing can't work, the consulate where you legally live is the safer route.

How do you prove you were in Spain on the day you filed your DNV?

For an in-Spain DNV filing, keep proof that you entered Spain and were there on filing day. Since about March 2026, applicants and advisers report refusals where the only proof was a police entry declaration made after arriving through another Schengen country. Practice is moving, so recheck before you fly.

The EU's Entry/Exit System (EES) went live on 10 April 2026, and passports are no longer stamped at the EU's external border. That removed the simplest proof people had. Entry-stamp practice changed again around late October 2026, and the immigration office hasn't published any instruction on what evidence it now expects.

If you arrive from another Schengen country there's usually no border check. So you may need to make a declaration of entry, a "declaración de entrada", at a police station, within 3 days where the rule applies. In 2026 practice, that declaration alone hasn't always been enough, and some refusals came without a request for more documents first.

The office has also asked people to prove they left their home country. The sole-trader case filed on 24 April 2026 got exactly that request on 25 May. The applicant had flown from an airport that no longer stamps biometric passports. The answer explained this and included the travel records.

What advisers recommend in 2026:

Fly direct to Spain where you can.

Keep boarding passes, e-tickets and any entry record for the whole trip from your home country.

Make the entry declaration within 3 days if you arrive from another Schengen country and the rule applies to you.

Consider a notary's record of your presence, an "acta de presencia". That's a record in which a Spanish notary certifies that you appeared before them on a given date. Many advisers add one shortly before filing.

Don't leave the Schengen area between arriving and filing.

There's no official checklist for any of this. It's what advisers use while the rules are unclear.

How long does the Spain digital nomad visa take in 2026?

By law, the Spain digital nomad visa is decided in 10 working days at a consulate and 20 working days in Spain. In 2026, applicants and advisers report most in-Spain main applicants decided in about 3–8 weeks, about a third taking longer than 20 working days. Filing to card in hand took roughly 1.5–3.5 months.

Working days exclude weekends and public holidays (Ley 39/2015), so 20 working days is about four weeks.

Stage

Legal period

Reported in 2026 (practice)

Consular decision

10 working days

Described as slower, with more requests for documents

In-Spain decision, main applicant

20 working days

Usually about 3–8 weeks; about a third past 20 working days

Family members' decisions

Joint filings are meant to be decided together

Often 4–8 weeks after the main applicant

Requests for more documents

Pause the clock

More frequent in 2026

Filing to residence card in hand

No single legal period

About 1.5–3.5 months

Legal periods from Ley 14/2013 arts. 75–76. Residence card in hand 3 August, about 14 weeks from filing.

Both were approved, and both took longer than 20 working days from filing.

If a request for more documents, a "requerimiento", arrives, the notice sets your deadline, usually 10 working days. Requests are sent electronically. If you miss the deadline, your file can be closed, so check your notifications every day after you file.

Timing matters too. In 2026, family decisions slowed over the summer. Advisers suggest not filing in the weeks before Christmas, when decisions slow again and family members can end up waiting in short-term rentals.

If the immigration office doesn't decide within 20 working days, your application counts as approved by law. This is automatic approval if they don't answer in time, "silencio positivo" (positive silence). That covers your spouse or a partner in an equivalent relationship (the immigration office's guidance includes stable partners as well as registered ones), children who depend on you and haven't set up their own household, and parents who depend on you.

Each person has a separate file linked to yours, with their own MI-F form, fee and proof of relationship and dependency. Joint filings are meant to be decided together, but in 2026 family decisions often came 4–8 weeks after the main applicant's. If your family follows later, advisers report that in practice they join after the main applicant has registered as self-employed.

A child who turns 18 before joining you, or before a renewal, can still come as family while they depend on you, for example as a full-time student with no work history. You're a Spanish tax resident if you spend more than 183 days a year in Spain, if your main economic interests are in Spain, or if your spouse and minor children live there. File in the 60 days before your permit expires. Filing up to 90 days after expiry keeps it valid but can bring a fine. There's no official DNV renewal checklist. Since July 2026, advisers report the immigration office asking for your last two Spanish tax returns and your Social Security history.

"Will I get stuck at renewal?" Less likely if you plan from day one. The only renewal document from the immigration office we could find is a general renewal guide from February 2018, older than this visa. So what goes in a renewal file comes from practice. In July 2026, about six firms reported those requests, traced to remarks by a coordinator at the immigration office on 22 July 2026. Gaps in your self-employed social security contributions or tax filings at renewal are on the 2026 trigger list.

The fix is boring and it works. File Spanish tax returns on time from your first year, keep your contributions up to date, keep your income at or above your household figure, and report changes within 30 days.

Spanish income tax returns are filed each spring, roughly April to the end of June, for the year before. So your first return comes the spring after your first year as a Spanish tax resident. The two returns asked for at renewal are usually your first two full years.

If you came on the consular visa, your first Spanish step is the residence permit of up to 3 years, filed in the 60 days before the visa expires. Renewals after that run in the same 2-year periods.

What if your income drops before renewal?

The Spain DNV renews only if you still meet the conditions it was granted on. The main one is income: at least 200% of the minimum wage for your household, from qualifying remote work. If your income has fallen below that, a straight renewal is at risk. In 2026 it was the renewal question applicants asked advisers most.

The legal test is gross income, as it was when you first applied. In 2026, though, advisers report reviewers reading renewal files against your Spanish tax returns, including the net figure. For freelancers, net means income after business expenses. Each year is measured against that year's figure:

Tax year

Single applicant, gross income a year (the higher, in-Spain basis)

2024

€31,752

2025

€33,152

2026

€34,188

So plan for your income to clear the figure both before and after expenses. If it only clears before expenses, add a short letter explaining your deductible costs. Advisers also report that someone who didn't live in Spain and filed no Spanish tax returns can't renew: the permit is for people who live and pay tax here.

If your income has dropped, these are the options advisers describe in 2026. Each one depends on your case, so check it before you rely on it:

Cover the gap with savings. Advisers apply the first-application rule at renewal too: up-to-date bank certificates showing savings you can access that cover the shortfall for the renewal period. Practice here is less settled, and savings support work income without replacing it.

Swap the main applicant. If your partner has qualifying remote work at or above your household figure, they can become the main applicant and you join as family.

Move to another permit. Advisers mention switching to Spain's general self-employment residence permit, "cuenta propia". It needs a business plan and is decided by the regional office, and outcomes vary by office.

Rebuild before you file. Win new foreign clients or a new contract early enough to show steady income in the months before renewal, and declare all of it in Spain.

Two things to avoid. Don't file late or padded tax returns to manufacture a better year. And don't sit on the drop: income falling below the threshold is a change you must report to the immigration office within 30 days, and an unreported change surfaces at renewal anyway.

When can you get permanent residence or Spanish citizenship on the DNV?

On the Spain digital nomad visa, long-term (permanent) residence comes after 5 years of continuous legal residence. Citizenship comes after 10 years in general, or 2 years for nationals of Ibero-American countries (the legal term for Latin America's Spanish- and Portuguese-speaking countries), Andorra, the Philippines, Equatorial Guinea and Portugal. The 1-year consular visa is expected to count toward the 5 years, but that isn't officially confirmed.

Long-term residence is in RD 1155/2024, in force since 20 May 2025. You may be away for up to 6 months at a time and 10 months in total, or 18 months in total for work.

The consular visa is a title to live in Spain in its own right, which is why its year is expected to count. We've found no official DNV-specific confirmation. On the in-Spain route the question doesn't arise.

Citizenship is in the Civil Code: 10 years of legal residence in general; 2 years for nationals by origin of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea and Portugal, and for Sephardic Jews ("dos años cuando se trate de nacionales de origen de países iberoamericanos … o Portugal"); and 1 year in special cases, such as a child born in Spain or a year of marriage to a Spaniard.

For Brazilians, Mexicans, Colombians and other Latin Americans, citizenship can come before long-term residence. If a consulate refuses you, use the remedy on the notice: usually asking the consulate to reconsider, a "reposición", within 1 month, or going to the High Court of Justice of Madrid within 2 months.

The rest of the 2026 list: duties that read as on-site work, crypto or passive money presented as work income, insurance that doesn't meet the rules, apostille QR codes that can't be verified, and gaps in self-employed contributions or tax at renewal. Almost all of them can be fixed before you file.

A request for more documents means the office wants more before it decides. Answer every point within the deadline printed on it. Requests add weeks, and the April 2026 case above was approved after one.

If you're refused, your route decides the remedy. A recurso de alzada is an appeal to the higher authority inside the government. A recurso de reposición asks the consulate to reconsider. The court appeal goes to the High Court of Justice of Madrid, the "TSJ". Deadlines are short, so take the notice to a qualified immigration professional the same day. For an in-Spain refusal, advisers report that some applicants fix the file and apply again instead of appealing, as long as they're still legally in Spain or can return legally. Which is better depends on the reason for the refusal.

Which Spain digital nomad visa myths should you ignore?

The Spain DNV errors we saw most often on other English-language guides in October 2026 were: a single income figure for everyone, a residence card on the consular visa, 5-year criminal record certificates, and a flat 24% Beckham rate.

What you may read

What the official sources say

One income figure applies to everyone

The rule is 200% of the minimum wage; consulates print €2,442 for 2026, and advisers apply €2,849 to in-Spain files

You need a residence card, a TIE, on the consular visa

The visa works without a residence card while it's valid: "sin necesidad de tramitar la tarjeta de identidad de extranjero"

The visa year definitely counts toward permanent residence, or definitely doesn't

Expected to count, not officially confirmed

Criminal record certificates must cover 5 years

Certificates cover the last 2 years; the 5 years is a signed declaration

Savings must equal 36 times the monthly shortfall

Savings may cover a shortfall for the whole permit validity (immigration office); no official multiplier exists

Beckham means a flat 24% on all income

24% on employment-type income up to €600,000, 47% above; savings income has its own scale

Every DNV holder gets Beckham

Employees qualify expressly; freelancers need a separate route

Owning 25% or less of your company is safe

The immigration office sets no percentage; control triggers the owner documents

Every document needs an apostille

Foreign public documents do; private documents generally don't

You'll have an answer in 20 working days

That's the legal period; in 2026 about a third of main applicants waited longer

Your passport will be stamped as proof of entry

Since 10 April 2026, the EES has replaced stamps at the external border

How can you build your own Spain digital nomad visa plan?

Compass Spain, our free planning tool, turns this DNV guide into your own dated plan: your route, your household's income figure (€2,442 at a consulate, €2,849 to plan for in Spain), your documents and your deadlines.

It asks where you live, which passport you hold, how you work and who's moving with you.
